I flag this mainly because the authors cover off quite an unusual case where a litigating party was ordered to disclose documents generated at the pre-action stage in return for being able to change experts, in what the court found was a clear case of ‘expert shopping’.

Just worth a read if you have time and flagged merely because it is yet another situation where other factors need to be considered when approaching disclosure.
