Discovery depositions tend to be a concept far more familiar in North America than in the UK. After all, as the authors explain, “for English lawyers and judges, the concept of a discovery deposition may still be alien or unorthodox”, but given proximity and links to the US, these are often needed in Cayman-related cases.
