Mr. Voth assists attorneys and clients with valuations, damages in disputes, and investigations. Mr. Voth’s forensic accounting experience includes consulting with both plaintiffs and defendants through all phases of the dispute resolution process, including case assessment, pleadings preparation, discovery due diligence, financial analysis and reporting, deposition and trial. Mr. Voth brings his background in accounting, finance, valuation, economics and statistics to bear on earnings evaluations, reasonable royalty studies, valuations, damages studies and other areas. He has testified in trial and/or deposition in a variety of matters including lost profits/income, intellectual property infringement, class action, defamation, legislative investigation, and breach of contract matters.
Mr. Voth’s valuation and reorganization experience includes advising debtors and creditors in various restructuring matters including proper financial reporting, reorganization plans, disclosure statements, financing, asset sales, out-of-court workouts, and avoidance actions. Valuation engagements have ranged from enterprise valuations under a variety of operating assumptions, to intellectual property valuations such as patents, non-compete agreements, and goodwill.
Some of Mr. Voth's notable experience includes: testimony for the prevailing party in the oft-cited copyright infringement indirect damages matter Mackie v. Reiser, 296 F.3d 909 (9th Cir. 2002); zero-damage ruling in an underlying patent infringement legal malpractice claim in excess of a billion dollars; testimony in multiple matters where class action certification was denied; and numerous multi-million dollar verdicts in various matters including breach of contract matters and trade secret theft.
Mr. Voth holds the following professional licenses: CPA/CFF, CVA, CIRA/CDBV and the CFE.
